Chapter 11
(SBRA)
The Chapter 11 Subchapter V was created in 2019 under the Small Business Reorganization Act (SBRA). Sometimes called a "Sub V," it is intended to streamline the bankruptcy process for those engaged in commercial or business activities. Deadlines are established more readily and a Trustee is appointed to assist with the progression of the case.
To be eligible for a Sub V, the debtor must have total debt of $3,424,000 or less, with at least 50% of the debt arose from commercial or business debt.
